Article 1: definitions

Member: the consumer who has entered into an agreement with Boutique Gym LUCIE. Boutique Gym: the building operating under the name LUCIE where facilities are provided to members. Location: Weena 101-103, Rotterdam. LUCIE is registered with the Dutch Chamber of Commerce under number 74296310. App: the application used for registration, information and payments. Membership: the membership agreed between the member and LUCIE.

Article 2: general

Every member must read these terms and follow the house rules. LUCIE may amend or supplement the terms and will publish changes on the website.

Article 3: the offer

LUCIE describes each membership on the website. An offer is valid for the period specified by LUCIE.

Article 4: membership

A membership becomes valid after acceptance in the app. LUCIE may refuse members when membership is full or when behaviour conflicts with LUCIE values. A 14-calendar-day cooling-off period applies after acceptance; services already used must still be paid for and a welcome gift must be returned when the agreement is withdrawn. Memberships and access cards are personal. A replacement card costs €10. Moving to an equally or more expensive membership is possible from the next payment period. The minimum age is 15; members aged 15 to 17 need permission from a parent or guardian. Personal details must be kept current in the app. Misconduct, violation of the house rules or non-payment may result in access being denied without a refund of the remaining membership fee.

Article 5: duration, cancellation and credits

LUCIE offers single credits, fixed memberships, flex memberships and personal training. Fixed memberships can be cancelled after one year with 30 days notice. Flex memberships can be cancelled after one month with 30 days notice. Memberships are billed every four weeks. After the agreed term, an agreement continues indefinitely until cancelled. During a fixed term, cancellation with 30 days notice may be possible after a documented move beyond a 60-kilometre radius or a medical condition that makes use of the facilities impossible. Credits are valid for four weeks, expire at the end of the period and do not roll over. Remaining credits expire when a membership is cancelled.

Article 6: access and opening hours

Training facilities are accessible only to members. Every visit is registered using a personal access card. Current opening hours are published on the website. LUCIE may change the schedule, facilities and opening hours and will try to arrange a replacement or catch-up session when a trainer is ill. Members must register for group classes in the app. A class can be cancelled up to 6 hours before it starts.

Article 7: fees

LUCIE may charge a registration fee of up to €20. Payment is collected in advance by direct debit. For a reversed payment, LUCIE may charge €3 administration costs for SEPA and €15 for Visa, Mastercard or AMEX. A member with overdue payment has two weeks to pay. LUCIE may then end the agreement or engage a collection agency. A fee change is announced at least four weeks in advance; the member may terminate the agreement within four weeks in that situation. Special offers do not create retrospective rights.

Article 8: own risk and liability

Use of the facilities is at the member’s own risk. LUCIE and its employees are not liable for damage or injury incurred while using the facilities. The member is liable for damage they cause to LUCIE property. LUCIE is not liable for loss or theft of personal belongings.

Article 9: complaints

A complaint must be submitted to info@joinlucie.com within four weeks of discovery. LUCIE will respond within four weeks of receipt. If LUCIE and the member cannot resolve the matter together, the member may approach the disputes committee. Disputes arising from the agreement are decided by the competent court in Rotterdam.

House rules

Always bring your fitness pass. Smoking, alcohol, drugs and doping are not permitted. Store belongings in a locker. Leave showers and toilets clean. Wear indoor sports shoes in the studio and return equipment after use.
